Important: These Terms cover the Website and any Website-provided services. The osTicket software you may download is open source and is licensed under a separate open-source license included with the software (“Open Source License”). Nothing in these Terms is intended to replace, restrict, or limit your rights under the Open Source License.

osTicket is maintained by Enhancesoft, LLC, which acts as the data controller for personal information collected through the osTicket website and communications. 2. Definitions
- “Software” means the osTicket open-source software and related components we make available for download.
- “Content” means text, graphics, images, documentation, downloads, and other materials made available through the Website.
- “User Content” means content you submit through the Website (for example: inquiries, feedback, comments, forum posts if any, bug reports, or code contributions).
- “Services” means the Website and any related services we make available through or in connection with the Website (which may include optional paid offerings).
3. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Website. If you use the Website on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

5.1 The Open Source License Controls
Your rights to use, copy, modify, and distribute the Software are governed by the Open Source License included with the Software distribution and/or in the Software’s source code repository.
Nothing in these Terms is intended to:
- Impose additional restrictions on the Software beyond the Open Source License; or
- Change the Open Source License.
5.2 No Warranty for Open Source Downloads
To the maximum extent permitted by law, the Software is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, except to the extent a separate written agreement signed by Enhancesoft provides otherwise.
5.3 Third-Party Components
The Software may include third-party open-source components subject to their own licenses. Those licenses apply to the applicable components.
6. Website License and Acceptable Use
6.1 Permission to Use the Website
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for its intended purposes, subject to these Terms.
6.2 Prohibited Conduct
By accessing and using the Website, you agree not to:
- Use the Website for unlawful, harmful, or fraudulent purposes;
- Interfere with or disrupt the Website, servers, or networks;
- Attempt to gain unauthorized access to accounts, systems, or data;
- Scrape, crawl, or harvest data in a way that is abusive, excessive, or violates applicable law;

By submitting User Content, you grant Enhancesoft a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting/technical purposes), display, perform, and distribute your User Content as necessary to operate, improve, and promote the Website and Services.
9.3 Code Contributions
If you submit code, patches, or pull requests intended for inclusion in the Software, you agree that your contribution may be incorporated into the Software and distributed under the applicable Open Source License (unless we agree otherwise in writing).
9.4 Feedback
If you provide suggestions, ideas, or feedback, you agree we may use them without restriction or compensation.
10. Intellectual Property and Trademarks
Except for the open-source Software governed by the Open Source License, the Website and its Content are owned by Enhancesoft or its licensors and are protected by intellectual property laws.
“osTicket,” associated logos, and related marks are trademarks of Enhancesoft. You may not use our trademarks in a way that suggests endorsement or affiliation without our prior written permission.
11. Links and Third-Party Services
The Website may link to third-party sites or services. We are not responsible for third-party content, policies, or practices. Your use of third-party sites/services is at your own risk and subject to their terms.
12. Optional Paid Services
If you purchase or use paid services from Enhancesoft (if offered), additional terms may apply (such as an order form, statement of work, subscription terms, or support policy). If there is a conflict between those terms and these Terms, the paid-service terms control for that paid service.

To the maximum extent permitted by law, Enhancesoft will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Website, Content, or Services.
To the extent permitted by law, Enhancesoft’s total liability for any claim arising out of or relating to these Terms will not exceed the amount you paid to Enhancesoft for the specific Service giving rise to the claim during the twelve (12) months before the event giving rise to liability, or $100 if you paid nothing.
Some jurisdictions do not allow certain limitations, so some of the above may not apply.
16. Indemnification
You agree to indemnify and hold harmless Enhancesoft and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising from:
- your use of the Website or Services;
- your User Content; or
- your violation of these Terms or applicable law.
17. Termination
We may suspend or terminate your access to the Website at any time if we reasonably believe you violated these Terms, or if needed to comply with law or protect the Website.
Sections that by their nature should survive termination will survive.
18. Governing Law and Venue
These Terms are governed by the laws of the State of Louisiana, excluding its conflict-of-law rules.
Any dispute arising out of or relating to these Terms will be brought exclusively in the state or federal courts located in Louisiana, and you consent to personal jurisdiction and venue there.
